BACKGROUND


UNDP is supporting the FATA Secretariat in the implementation of the FATA Sustainable Return and Rehabilitation Strategy which seeks to address the most immediate rehabilitation and recovery needs in FATA in order to facilitate sustainable returns of TDPs families. A core pillar of this strategy is the reform of governance, including judicial processes.


UNDP Pakistan is also extending technical assistance to the FATA secretariat for review and implementation of formal judicial and legal arrangement for prosecution of crimes and offences in FATA. At the present, prosecution and adjudication of crimes and offences is carried out under the provision of Frontier Crimes Regulation (FCR). The justice system is deeply rooted in the local culture and tradition. The local Rewaj serves as penal and procedure code, Jirga, described as Council of Elders in the FCR, serves as jury to try cases and render verdict and the Political Agent serves as magistrate and judge.


To provide technical assistance to the FATA Secretariat for review and implementation of formal judicial and prosecution services as part of the FATA reforms agenda, UNDP is seeking the services of a Legal Policy Consultant (Prosecution & Judiciary).


Under the supervision of the Secretary Law and Order, and matrix managed by the Intl. Governance Advisor, the Legal Policy Consultant will support the Rule of Law Reform Unit, Law and Order Department FATA Secretariat, by providing policy advice and technical support for prosecution and judicial departments in FATA.


Scope of Work:


Building the context through critical reviews and technical assessment of Judicial System in FATA


Building the context through critical reviews and technical assessment of Prosecution System in FATA



  • Critically examine development and evolution of prosecution system i.e. extension of provisions of Pakistan penal code and criminal procedure code and evidence law in Khyber Pakhtunkhwa and Provincially Administrated Tribal Areas, in particular Malakand Agency;



Technical Assistance for the step by step implementation of Judicial and Prosecution plans.



  • To provide technical assistance and advice on judicial and prosecution reforms agenda and various step by step components of implementation plans;




  • To provide technical assistance to the FATA Secretariat during for implementing the formal and hybrid judicial and prosecution models in FATA;




  • Provide technical assistance and advice to Rule of Law Team in discharge of its various activities.



Capacity development and performance management



  • Technical assessment and to devise mechanism for capacity building of the newly appointed judicial and prosecution officials in FATA;




  • Devise mechanism and performance management model for judicial and prosecution departments in FATA;
