BACKGROUND


UNDP is supporting the FATA Secretariat in the implementation of the FATA Sustainable Return and Rehabilitation Strategy which seeks to address the most immediate rehabilitation and recovery needs in FATA in order to facilitate sustainable returns of TDPs families. A core pillar of this strategy is the reform of governance, including judicial processes.


UNDP Pakistan is also extending technical assistance to the FATA secretariat for review and implementation of formal judicial and legal arrangement for prosecution of crimes and offences in FATA. At present, prosecution and adjudication of crimes and offences is carried out under the provision of Frontier Crimes Regulation (FCR). The justice system is deeply rooted in the local culture and tradition. The local Rewaj serves as penal and procedure code, Jirga, described as Council of Elders in the FCR, serves as jury to try cases and render verdict and the Political Agent serves as magistrate and judge.


To provide technical assistance to the FATA Secretariat for review and implementation of formal judicial and prosecution services as part of the FATA reforms agenda, UNDP is seeking the services of a Rewaj Policy Consultant (FATA).


Under the supervision of the Secretary Law and Order, and matrix managed by the Intl. Governance Advisor, the Rewaj Policy Consultant will support the Rule of Law Reform Unit, Law and Order Department FATA Secretariat, by providing policy advice and technical support for the codification of tribe wise and Agency wise Rewaj in FATA.


Scope of Work:


Literature review and collection of data/information


  • Critical evolution of Rewaj in FATA and Literature review on the existing tribe and Agency wise prevalent Rewaj;

  • To critically examine the existing system of criminal and civil adjudication system in FATA based on Rewaj and to identify strengths and weaknesses;

  • Design guidelines for collection of quantitative and qualitative data on Rewaj based on Focal Group Discussion, Key Informant Interviews, consultation with civil society members, elders, FATA Administration etc.

Critical evaluation of existing codified Rewaj document in Kurram Agency


  • Critically review and evaluate the codification of Rewaj, already done in Kurram Agency, as case study;

  • Drafting detailed handbook on codified Rewaj from the case study

Documentation/Codification of tribe wise Rewaj for each Agency/FRs


  • Documentation of tribe wise data on Rewaj for each Agency/FRs

  • Cross validation of the data collected on Rewaj with local Elders, Civil Society, FATA Administration etc.

  • Identification of Rewaj, which are in conflict with the formal legal statutes

Implementation Plan for the Codified Rewaj in FATA


  • Drafting rules for the utilization of codified Rewaj by the judicial and prosecution departments for the delivery of justice in FATA

  • Output-input matrix for the implementation plan

The duties and responsibilities will be broadly along these lines, may shift as and when the reform agenda evolves and develops.
